Session 1: Recent changes to PTAB practice have been remarkable and fast-paced. This panel presentation will address expected guidance from the USPTO, recent case law, and trends in the practice. We expect the panel will include APJs. Possible topics include claim construction, claim amendments, the revised Trial Practice Guide, post-SAS remands, Section 101 guidelines, multiple proceedings in light of Sections 314(a), 315(d) and 325(d), ex parte reexams and reissue in parallel with PTAB trials, precedential decisions and ex parte appeals from examination. Session 2: This session will feature moderated interactive table discussions on some advanced topics in PTAB practice. We expect that this will offer the opportunity for meaningful small group discussions with APJs. Possible topics include:

  2. Public availability of prior art,
  3. Motions to Amend,
  4. Update to Trial Practice Guide
    • Remand Practice
    • Protective Orders
    • Discovery
  5. Multiple Petitions and discretionary denials, and
  6. Effect of claim construction move from Broadest Reasonable Interpretation.
